This position is a member of the Indirect Tax group and is responsible for leading and directly managing all aspects of the indirect tax function for the United States and Canada including multi-state sales and use, federal and state excise, including Superfund tax, Canadian GST/PST, property tax compliance and gross receipts and miscellaneous taxes for multiple entities operating in many jurisdictions.  This position reports to the Director, Indirect Tax and works collaboratively with other members of the tax function and the enterprise.

 

This role has 5 key areas of responsibility:  1) Oversee all aspects of US and Canadian indirect tax, including tax risk management: establishing and maintaining key controls and processes to meet our compliance obligations, manage tax audits, support accounting requirements including need for accruals, SOX controls/testing, etc. 2) manage outsourced activities with vendors, especially tax compliance 3) Develop relationships with key stakeholders in order to proactively provide advice and support to the business functions to manage indirect tax consequences and collaborate with other tax team members to effectively manage his/her responsibilities 4) Develop and maintain efficient and effective processes leveraging technology where appropriate 5) Monitor legislation and in collaboration with outsource vendors assimilate legislative changes into compliance processes 6) M&A support, as needed.  Clear, open and regular communication with your supervisor, your team, and others is required.

A Day In The Life:

This role will lead a team (direct and indirect reports, outsource providers, and advisors to meet the needs of the organization in an efficient and effective manner, minimizing costs while managing risk, and effectively communicating key aspects of managing these responsibilities with tax leadership including but not limited to:

  • Effectively manage and lead the outsource compliance process with external providers
  • Lead the relationship with the outsourcing vendors
  • Establish processes, procedures with the vendors and internal resources to ensure tax compliance, payments and filings, are made timely and materially accurate
  • Co-develop with vendors on  controls to ensure quality and accuracy of input (data) and output (returns)
  • Develop and monitor KPIs to align expectations with the vendor and ensure identification and implementation of  value added enhancements (i.e. process and tax minimization)
  • Develop and execute a tax controversy strategy including appropriate proactive preparatory activities, risk management, and effective management of the process, including resources and approach and effectively communicate with upper management
  • With a focus on risk management, ensure key controls are in place and followed including but not limited to
  • Develop framework and procedures to ensure compliant documentation of all indirect tax matters 
  • Ensure applicable tax accounts are properly stated and timely and accurately reconciled with adequate support
  • Oversee/conduct research to support taxability determinations and positions
  • Ensure supporting documentation for all indirect tax matters is appropriately maintained and stored in a medium supported by the Company’s record retention policy
  • Ensure the Company’s Delegation of Authority policy is adhered to for US and Canada indirect tax matters
  • Responsible for compliance with Sarbanes-Oxley (SOX) requirements are met, including coordination with internal and external audit/testing teams and partnering to modify key controls and testing plan as warranted
  • Ensure indirect tax processes, upstream and downstream, are optimized and working effectively to appropriately address LYB’s indirect tax responsibilities, embrace and embed continuous improvement into the function including
  • Ensure that current/accurate desk policies and procedures for various existing processes are in place and followed
  • Create new procedures as required resulting from mergers and acquisitions, legislative changes, etc.
  • Identify improvement areas for indirect tax to create value (cost reduction, risk control or similar)
  • Work with relevant internal and external stakeholders to implement improvement initiatives
  • Leverage technology and optimize automation, as appropriate 
  • In collaboration with key business functions incorporate improvements to the purchase order and similar processes to improve quality of tax determinations and audit support 
  • Maintain and expand current tax technical knowledge of responsible indirect tax matters and stay abreast of emerging tax issues and legislative developments 
  • Anticipate and evaluate the impact of emerging issues on LYB
  • Communicate to leadership with impact and recommended actions, if any
  • Assimilate legislative changes into compliance processes
  • Oversee and perform indirect tax advisory functions to all business units and partner with other internal functions to accomplish objectives, including but not limited to 
  • Develop relationships with key stakeholders to proactively provide advice and collaborate to effectively manage LYB’s indirect tax liabilities

You Bring This Value:

Education:

  • Bachelor’s degree in Accounting or Finance.
  • Masters in Tax, preferred.

Work Experience:

  • Minimum of 15-20 years of relevant indirect tax leadership and management experience.  Relevant experience in similar set ups with largely outsourced compliance work is strongly preferred.

Licenses & Certifications:

  • CPA license, CPA candidate, CMI designation preferred.
