Basic Function

The Capital Project Contracts Manager is primarily responsible for all aspects of contracting for assigned capital projects in the range of $10-$750MM Total Installed Cost (TIC). Depending on project size and complexity, the Capital Project Contracting Manager may also direct a contract administrator or contract administration employees of an engineering and construction management firm.

Deliverables

  • Develop and own the project contracting strategy and project contracting plans
  • Ensure cost of contracted work is to budget and that the delivery supports the project schedule
  • Ensure contracts are executed in accordance with Legal and Corporate requirements
  • Ensure approved and qualified contractors are selected
  • Negotiate terms and change orders on behalf of LyondellBasell
  • Manage effective internal client and external contract relationships to benefit the Project

Responsibilities & Accountabilities

  • Establish contracting plan, strategy and milestone schedule
  • Ensure contracting performance meets project plan, schedule and budget
  • Execute strategic contract agreements where available, following the agreed processes and project contracting strategy
  • Ensure that contract correspondence, documentation, and records are being prepared accurately and are current
  • Implement and communicate contract deliverables measurement and or incentive systems that clearly indicate the performance level of the contracting strategy and supplier effectiveness. Maintains focus on achieving milestone dates, added value, lowest total “life cycle” cost and cost savings
  • Manage the RFx process and develop commercial evaluation criteria and weighting
  • Effective contract commercial negotiation on behalf of LYB with the inclusion of Legal, Risk Management, and Finance, as required
  • Ensure compliance with LYB supplier qualification, safety and technical review process
  • Liaise between Technical Services, Legal, Risk Management, Global Engineering Services, and Site Technical Authority
  • Ensure adherence with Trade Compliance requirements
  • Promote excellent working relationships with internal customers and other supporting organizations
  • Maintain relationships with key business partners and key supplier contacts
  • Ensure that business drivers, departmental goals and measures are aligned
  • Recognized as a leader and subject matter expert in developing contracts for engineering, construction labor and general services for capital projects; sharing knowledge and expertise to the project team within this area

Min. Qualifications

Education

  • Bachelor’s degree required

Work Experience

  • 10+ years of project contracting experience within an Owner organization or EPC organization working directly on contracts for capital projects with TIC of more than $10 MM is highly preferred
  • 15+ years of oil, gas, or petrochemical related industry experience and knowledge related to construction or services contracting
  • Experience in negotiating commercial terms for multi-million dollar contracts
  • Experience in developing project contracting plans and project contracting strategies

  • Ability to negotiate with contractors on legal and commercial aspects of complex contracts
  • Deep understanding of “fit for purpose” compensation models and contracting strategies within the Capital project process
  • Ability to travel locally to jobsites or Engineering offices as needed
